By placing a booking with Glen Dessary Estate (the “Estate”, “we”, “us” or “our”), you, as the lead guest, and all members of your booking party (“you” or “your”), agree to these Terms & Conditions.

These Terms & Conditions apply to accommodation and activities booked through Glen Dessary Estate. Certain activities, including deer stalking, are subject to additional supplementary terms, as set out below.

1. Booking and Payment

A 20% deposit is required at the time of booking to confirm a reservation.
The remaining balance is due 30 days before the scheduled arrival date .
For bookings made within 30 days of the scheduled arrival date, the full booking amount is payable at the time of booking .
If any payment is not received when due, the Estate reserves the right to treat the booking as cancelled by the client, subject to the cancellation provisions below.
Payments may be made by bank transfer or through the Estate's online payment facility.
Any charges incurred by the Estate as a result of a dishonoured or failed payment must be reimbursed by the lead guest within seven days of being requested to do so.

2. Cancellation by the Client

More than 30 days before arrival

If a booking is cancelled more than 30 days before the scheduled arrival date , the deposit will be refunded, less an administration fee of £250 .

30 days or less before arrival

If a booking is cancelled 30 days or less before the scheduled arrival date , the booking is non-refundable.
The client remains liable for the full booking amount applicable to the confirmed booking , whether or not the balance has already been paid.
Where any balance remains outstanding at the time of cancellation, the outstanding amount will become immediately due and payable.
Clients are strongly advised to obtain appropriate travel and cancellation insurance.

Changes to a booking

Any request to change the dates, accommodation, number of guests or other material details of a confirmed booking is subject to the Estate's agreement and availability.
A requested change does not automatically entitle the client to a refund or reduction in the booking price.

3. Cancellation or Changes by the Estate

In exceptional circumstances, the Estate may need to cancel, alter or postpone a booking due to circumstances beyond its reasonable control.
Where the Estate cancels a booking and is unable to provide the accommodation or service booked, the Estate's liability will, subject to any rights that cannot lawfully be excluded, be limited to refunding payments already made in respect of the affected booking.
The Estate will not be liable for additional costs, expenses or losses incurred by the client as a result of such cancellation, including travel, transport or alternative accommodation costs, except where such liability cannot lawfully be excluded.
The Estate will make reasonable efforts to notify clients as soon as practicable of any such circumstances.

4. Check-in and Check-out

Check-in is between 4pm and 8pm on the day of arrival.
Check-out is by 10am on the day of departure.
Late check-out may incur an additional charge and must be agreed with the Estate in advance.

5. Access and Travel Considerations

Glen Dessary Estate is situated in a remote Highland location.
Guests are responsible for ensuring that their vehicle is suitable for rural access, particularly during periods of adverse weather. A suitable 4x4 vehicle may be necessary during winter or difficult conditions.
Directions and access information will be provided, but GPS and mobile navigation systems may not always be reliable in the area.
The Estate is not responsible for delays or additional costs arising from road closures, adverse weather, transport disruption or other circumstances outside its reasonable control.
Guests should allow sufficient time for their journey and take appropriate account of the remote location.
Travel arrangements to and from Glen Dessary Estate remain the responsibility of the guest. The Estate does not provide transfer services beyond the Estate gate and guests must arrange their own transport for arrival and departure.
The Estate may, on request, provide details of taxi, transfer or transport providers with which it is familiar. Any such provider is an independent third party and is not employed by or acting on behalf of the Estate. The Estate accepts no responsibility for the acts, omissions, delays, cancellations or failures of any third-party transport provider.
Guests remain responsible for ensuring that suitable transport is arranged to enable them to depart the Estate by the agreed check-out time. Where a guest is unable to leave as arranged due to the failure, delay or cancellation of their transport provider, any additional accommodation, services or other costs incurred beyond the confirmed booking period will be charged to the guest.

6. Occupancy and Guest Conduct

The maximum occupancy is:

15 guests at Glen Dessary Lodge; and
6 guests at Glen Dessary Bothy.

The maximum occupancy must not be exceeded.
The lead guest must be over 21 years of age and is responsible for the conduct of all members of their party.
Parties, events or loud music are not permitted unless expressly approved by the Estate in writing.
Guests must respect the privacy, peace and property of the owners, staff, neighbours and other guests.
The Estate reserves the right to terminate a stay without refund where guests engage in behaviour that is unsafe, abusive, threatening, seriously disruptive or materially interferes with the enjoyment or safety of others.

7. Wildlife and the Environment

Glen Dessary Estate is situated in a natural and working Highland environment.
Wildlife, livestock, deer and other animals may be encountered on or around the Estate. Guests must not feed, chase, approach or otherwise interfere with wildlife or livestock.

Guests must:

respect the natural environment;
leave gates as they find them;
respect farming and wildlife management operations;
dispose of waste responsibly; and
follow any reasonable instructions given by Estate staff.

Open fires and fireworks are not permitted except where expressly authorised by the Estate.

8. Damage and Liability

Guests are responsible for any loss or damage caused to the Estate, its buildings, furnishings, equipment or facilities by them or members of their party, other than reasonable wear and tear.
Any accidental damage should be reported to the Estate as soon as reasonably practicable.
In certain circumstances, a refundable damage deposit of up to £1,000 may be required. Any such deposit will be returned less the reasonable cost of repairing damage or dealing with excessive cleaning.
Guests are responsible for taking reasonable care of their own safety and that of members of their party and must follow all reasonable safety instructions given by the Estate, its staff or contractors.
Nothing in these Terms & Conditions excludes or limits liability which cannot lawfully be excluded or limited.
The Estate is not responsible for loss of or damage to guests' personal belongings, vehicles or other property except where liability arises which cannot lawfully be excluded or limited.
Guests are advised to obtain appropriate travel and personal insurance.

9. Outdoor Activities

Participation in outdoor activities at or arranged by the Estate, including fishing, Argocat trips, clay-pigeon shooting, hiking and other outdoor activities, involves inherent risks associated with weather, terrain, water, wildlife and physical exertion.
Guests must ensure that they are appropriately equipped and reasonably fit for the activity they undertake.
All safety instructions provided by the Estate, guides or activity providers must be followed.
Children under 18 must be accompanied and supervised by a responsible adult at all times unless otherwise agreed in writing.
The Estate reserves the right to refuse participation or terminate an activity where a guest's conduct, equipment or condition presents a safety risk.

10. Facilities and Utilities

Glen Dessary Lodge is an off-grid property.
Although power and water supplies are normally reliable, interruptions may occur due to circumstances outside the Estate's reasonable control.
Wi-Fi is available but may be limited or unavailable because of the Estate's remote location.
Internet access is provided for reasonable personal use. Guests must not use the Estate's internet connection for unlawful activities.
There is no mobile phone signal on Glen Dessary Estate.

11. Pets

Well-behaved pets may be permitted in designated communal areas of the Lodge subject to prior agreement.
Pets are not permitted in bedrooms or carpeted areas.
A pet charge may apply.
Pets must be kept under control at all times and must not disturb wildlife, livestock, neighbours or other guests.
Guests are responsible for cleaning up after their pets.
Estate kennels may be available by prior arrangement.

12. Smoking

Smoking is strictly prohibited inside the Lodge.
Smoking outside is permitted only in designated areas.
Cigarette ends and other smoking materials must be disposed of safely and responsibly.

13. Drugs and Alcohol

There is a zero-tolerance policy for illegal drugs anywhere on the Estate.
Possession or use of illegal substances may result in immediate termination of the stay without refund and may be reported to the relevant authorities.
Excessive alcohol consumption, drunken or disorderly behaviour, or behaviour that places guests, staff, property or wildlife at risk will not be tolerated.
The Estate reserves the right to require any guest or group to leave immediately where behaviour is unsafe, aggressive, irresponsible or seriously disruptive. No refund will be payable in such circumstances.

14. Behaviour Towards Staff

Guests must treat Estate staff, guides and contractors with courtesy and respect.
Abusive, threatening, intimidating or aggressive behaviour towards any member of staff will not be tolerated.
The Estate reserves the right to terminate the stay immediately and without refund where such behaviour occurs and may refuse future bookings.

15. Drones

Drones may only be flown for personal recreational purposes with the prior agreement of the Estate.
The surrounding airspace forms part of a designated low flying area and military aircraft may operate at low altitude.
Guests are responsible for checking applicable restrictions, including current NOTAMs and relevant airspace information, before flying.
Drones must never disturb or interfere with deer, wildlife, livestock, stalking parties, walkers, guests, staff, aircraft or property.
Commercial drone filming or photography requires prior written approval from the Estate.
All drone operations must comply with applicable CAA regulations and other applicable law.
The Estate may withdraw permission to fly a drone at any time.
Any drone accident, incident or near miss must be reported to the Estate without delay.

16. Dogs

A charge of £25 per dog applies for the duration of the stay.
Dogs are restricted to designated communal areas and are not permitted in bedrooms or carpeted areas.
Dogs must be kept under control at all times and must not disturb wildlife, livestock, staff, neighbours or other guests.
All fouling must be cleaned up and disposed of responsibly.
Estate kennels may be available by prior arrangement.

17. Deer Stalking

All guests participating in deer stalking must read and agree to the Estate's separate Deer Stalking Terms & Conditions before taking part.

The Deer Stalking Terms & Conditions contain additional provisions relating to:

stalking bookings and payment;
cancellation;
reductions in the number of stags or hinds;
adverse weather and ground conditions;
unsuccessful stalks;
recommended additional stalking days;
firearms and rifle safety;
shooting and shot placement;
animal welfare;
fitness and physical requirements;
conduct on the hill; and
the responsibilities of guests and stalkers.

The Deer Stalking Terms & Conditions form part of the contract for any stalking booking.
Where there is any inconsistency between these main Terms & Conditions and the Deer Stalking Terms & Conditions, the Deer Stalking Terms & Conditions will take precedence in relation to the deer stalking booking and activity .
By booking or participating in a stalk, guests confirm that they have read, understood and accepted the Deer Stalking Terms & Conditions.

18. Force Majeure and Circumstances Beyond Our Control

The Estate will not be responsible for failure, interruption, delay or alteration to a booking caused by circumstances beyond its reasonable control.

Such circumstances may include, but are not limited to:

extreme or adverse weather;
natural disasters;
fire or flood;
epidemic or pandemic;
government restrictions;
road closures;
power or utility failure;
transport disruption;
industrial disputes;
restrictions affecting access to the Estate; or
other circumstances which could not reasonably have been anticipated or prevented.

Where such circumstances affect a booking, the Estate will make reasonable efforts to minimise the impact and communicate with affected guests.
Any rights to refunds will be determined in accordance with the cancellation provisions applicable to the booking and any rights that cannot lawfully be excluded.

19. Lost Property

Any lost property found following a guest's stay will normally be retained for up to one month.
The Estate will make reasonable efforts to reunite lost property with its owner but cannot accept responsibility for loss or damage to items left behind.
Where practical, items may be returned by recorded delivery at the owner's expense. Alternatively, collection may be arranged by the owner.

20. Insurance

Guests are strongly advised to obtain appropriate travel and cancellation insurance before travelling to Glen Dessary Estate.
Insurance should, where appropriate, cover cancellation, travel disruption, illness, injury, outdoor activities and personal belongings.
For deer stalking, guests should ensure that their insurance specifically covers participation in deer stalking and associated outdoor activities.

21. Acceptance of Terms

By making a booking, paying a deposit or participating in an activity at Glen Dessary Estate, the lead guest confirms that they have read, understood and accepted these Terms & Conditions and agrees that all members of their party will comply with them.
The lead guest is responsible for ensuring that all members of their party are made aware of the relevant terms.

22. Governing Law

These Terms & Conditions are governed by Scottish law .
Any dispute shall be subject to the jurisdiction of the Scottish courts, subject to any mandatory rights or protections available to consumers under applicable law.
